This International Underwriting Association (IUA) remote market briefing will highlight the decision of the High Court regarding business interruption policy coverage relating to Covid-19, and the consequences.
In June 2020 the FCA, with the cooperation of leading insurers, initiated a test case in the High Court to determine a number of common but complex coverage issues which had arisen in the wake of COVID 19 under a range of property and business interruption polices.
The issues which the Court has been asked to resolve, however, extend far beyond the property market and include the correct construction of clauses and terms which are used extensively in a wide range of insurance contracts.
The Court’s landmark judgement, published on 15 September 2020, will be discussed at this market briefing event and will explain the decision and its consequences.
