Lost in translation: claims handling in UK and USA jurisdictions

Lost in translation: claims handling in UK and USA jurisdictions

In this IIL claims lecture Robert Cosgrove outlines how American English differences from ‘proper’ English can create difficulties in UK insurance litigation. He will focus on some common policy wordings and expressions that can result in coverage disputes and bad faith litigation.

Specifically, Bob will speak about how a word or phrasing that makes perfect sense in the London Market will not translate when placed before an American judge or jury. The lecture will also discuss differences in the approach to mediation and ways Underwriters can avoid being dragged down into a bad faith quagmire.

By the end of this lecture members would have gained an insight into:

-Wordings to avoid or clarify
-The differences in mediation
-Ways to avoid bad faith traps
