If you have or if you have any responsibility for new claims and wish to avoid missing any coverage issues and losing rights to coverage defences, this is one presentation you do not want to miss.
The questions on the checklist range from obvious, but often ignored, issues such as whether the entity seeking coverage is the actual insured on the policy, to issues that can be complex, such as what date to use to determine whether the claim falls within the policy period.
Patti Potash, US counsel, White Fleischner & Fino LLP, who handles coverage matters in all 50 US States, will provide and discuss a checklist of the questions to ask upon receipt of a new claim. The checklist is designed to ensure that you do not overlook any coverage issues and that you avoid any coverage fiascos. The checklist will help you decide if there should be a denial of coverage, a reservation of rights, further investigation or the retention of coverage counsel.
In discussing each question, Patti will explain the States’ majority and minority positions and some recent changes to these positions.
In this session, Patti will focus on claims under a Commercial General Liability Policy but the questions on the checklist are relevant to almost all types of policies and claims. In fact, US Insurers for all types of coverage have Patti’s checklist posted on their desks as a reminder of the questions to consider for any new claim.
