Defense of Claims Filed Against Foreign Insureds In United States’ Courts

Leisure businesses which operate in the Caribbean generate a substantial amount of litigation that is filed in Miami state, as well as federal courts. The London market has a substantial presence in the insuring of these types of risks which include hoteliers, independent cruise line shore excursion operators, concessionaires and transportation vendors.

This market briefing will highlight procedures involved in the litigation of claims against Caribbean resorts and leisure interests and will be of interest to underwriters and claims personnel who write policies for and handle claims against foreign entities. Topics to be discussed include: pre-suit investigation; the commencement of litigation; personal jurisdiction; forum non conveniens; vicarious liability; alter ego liability; joint venture liability; choice of law; release and insurer bad faith.

Mr. Bruce Marx, the event’s speaker, will provide insight to the various substantive and procedural issues which arise in the handling of a claim brought against a foreign insured in a United States’ court.

Bruce Marx is a partner of the law firm of Marlow, Adler Abrams, Newman & Lewis law firm that defends insureds involved in retail/hospitality, products liability, transportation, construction and professional liability litigation. They are located in Coral Gables, Florida. Mr. Marx has been a practising defence attorney since 1991 and specializes in the defence of complex claims against aviation, maritime and hospitality-related businesses.

Mr. Marx’s international casualty practice involves the defence of claims against foreign resort operators, independent cruise line shore excursion operators, concessionaires and transportation companies located in the Caribbean including then countries of Jamaica, Mexico, The Bahamas, Costa Rica and the Turks and Caicos Islands. Due to his exposure to the various procedural issues which confront foreign business interests which are sued in U.S. courts, Mr Marx has been able to develop a specialization in the presentation of the forum non conveniens and personal jurisdiction defences. He also represents domestic hotel and leisure interests. Due to his proximity to the Caribbean, he has been asked to perform accident investigation into events immediately after occurrence, allowing the preparation of an early defence to a claim in the event that litigation ensues. Mr Marx has also been approached by Caribbean resort and leisure business operators to provide assistance in risk management analysis. He is a member of the Florida Bar and partakes in regular speaking engagements including presentations to the Lloyd’s market.
