Despite the increase in technical specialist knowledge within shipyards, it can be the case that not all repairs are successful or the damage is still on-going.
With this in mind, how sure are you that the original peril has run its course? What happens when repaired machinery, or hull, fails again and, how many times the underwriter – and which underwriter – should indemnify for the loss?
This market briefing will explore the practical tools to consider the definition of “separate accident” or if something is a “new intervening cause”.
