Mass litigation has surged across the United States in recent years, with high-profile cases involving talc, Roundup, PFAS and addictive software emerging at an unprecedented rate. Between 2016 and 2022, two to three new mass litigation events began each year. Looking ahead, climate-related lawsuits are likely to accelerate, and entirely new litigation categories – such as those targeting ultra-processed foods and microplastics – could soon appear.
