
In this IIL accident webinar, Samantha Silver talks about the current position in relation to product liability law as regards medical devices in the EU, as well as England and Wales – post-Brexit, particularly in light of new and emerging technologies and increasing focus on regulation and consumer safety.
The UK’s product liability laws date back to the 1980s despite many products today looking very different to those put on to the market 40 years ago. The interpretation and application of these laws have, in recent years, been subject to challenges in the English and Scottish courts, spearheaded by litigation in the medical devices arena. Although the proposals to change the product liability regime have been resisted to date by the legislature, they continue to be the subject of debate in legal and consumer circles, particularly in terms of its impact on medical device litigation.
