SUMMARY:Webinar: Expecting Clauses at Christmas - Silent Cyber Risks and Lloyd’s Phase 3
DESCRIPTION:This International Underwriting Association (IUA) webinar will compare and contrast model cyber clauses published ahead of 1/1/2021 that will be central to ongoing discussions during this key renewal period. \nDescription\nThe Phase 3 deadline of Lloyd’s Bulletin Y5277 is fast approaching and extends to a wealth of liability classes\, requiring clarity of coverage in respect of cyber risks for policies incepting on or after 1 January 2021. A number of model clauses have been published by the IUA and LMA as this deadline rapidly approaches. \nAt part one of this four-part mini-webinar series\, the IUA guest speakers will provide thematic commentary on the cyber clauses published to date. They will consider the way in which these clauses are structured and the key defined terms used within. It is hoped that this commentary will provide further insight to IUA members when considering the impact of these clauses on policy wordings. \nSpeakers\nJulian Miller\nJulian Miller is a partner of DAC Beachcroft specialising in insurance and reinsurance coverage. His work covers technical coverage issues\, drafting wordings and dispute resolution. \nHe has advised on\, or drafted\, a number of the cyber policies in the London market. He’s also advised on many of the most challenging issues of the day\, such as: \n\nNon-affirmative cyber exposures\nInsurability of fines and penalties for breach of GDPR\nCyber extortion and legality of ransom payments\nFacial recognition technology\n\nHe has been identified as a Super Lawyer and as a Chambers Global Leader in his field. Working with Hans Allnutt and Patrick Hill\, he has helped build the DAC Beachcroft team\, which is regarded as the leading cyber legal team in London. \nJulian work involves sitting on a number of cyber committees including: LMA: Cyber War Working Group (2019)\, Cyber Claims Committee – Ransomware Loss Reimbursement Protocol (2020)\, and IUA: Cyber Exclusion Clause Working Group (2017-2019)\, Professional and Financial Lines Cyber Working Group (2019) and Cyber Legal and Claims Sub-Group (2020). \nCameron Carr\nCameron Carr is a solicitor in the Cyber & Data Risk team at DAC Beachcroft. His work focuses on advising on data breach response\, data subject litigation\, cyber related policy coverage and cyber policy wordings. \nHe regularly acts as breach response counsel across a range of sectors including healthcare\, local government\, financial institutions and education. He also defends claims pursued by data subjects arising out of those breaches. He has a particular interest in ransomware response\, which forms a substantial portion of his practice. \nCameron is a member of the Forum of Insurance Lawyers (FOIL) and sits on the Cyber and Digital Liabilities Sector Focus Group. He is also a member of the Chartered Insurance Institute and is working towards the ACII qualification. He has also completed two secondments in the London Market\, as a Claims Adjuster and then Assistant Claims Counsel. \nCameron advises on coverage issues usually with an international and cyber element and has experience advising on claims in Europe\, Latin America and the United States. He works alongside Julian on non-affirmative cyber projects for the market.
